Professor Jo Shaw, Head of Edinburgh Law School, has provided expert commentary for Al Jazeera on the US Supreme Court's ruling upholding birthright citizenship. The Court rejected the Trump administration's attempt to reinterpret the 14th Amendment and end automatic citizenship for children born on US soil to parents without full documentation or with time-limited visas. Drawing on her own research into similar arrangements in Latin America, Professor Shaw noted that a substantial number of Latin American countries have comparable citizenship provisions, each shaped by its own constitutional and legislative framework. She also highlighted an important contrast: unlike the US, Chile and Colombia do not extend birthright citizenship to "transient foreigners," a restriction her research shows can have serious exclusionary effects depending on how it is applied.
