"In this context, the article identifies an increased potential for circumvention under the AI Regulation in view of the formal connection between Art. 3 No. 3, Art. 25 AI Act and Art. 99 AI Act (fines). There appears to be no approach to address this sufficiently, although a solution based on the interpretation of Article 99 appears to be the most promising from a dogmatic point of view."
