Yet in 44% of economies, firms donโt even have access to mediation, according to the World Bankโs Business Ready 2025. That leaves many businesses with one option: court litigation, often slow, costly, and damaging to future partnerships. Hereโs the reality: ๐น Commercial mediation is available in just 56% of economies ๐น Access drops sharply in lower-income countries, to less than 20% ๐น In Sub-Saharan Africa, only 26% of economies offer it ๐น Meanwhile, common law systems see higher uptake (73%) than civil law systems (49%) ๐ช๐ต๐ ๐ฑ๐ผ๐ฒ๐ ๐๐ต๐ถ๐ ๐บ๐ฎ๐๐๐ฒ๐ฟ? Because mediation works differently. A neutral third party helps businesses resolve conflicts faster, preserve relationships, and find practical solutionsโnot just legal wins. Without it, firms may: โ๏ธ Avoid risks and innovation โ๏ธ Tie up capital in lengthy disputes โ๏ธ In some cases, shut down altogether ๐ช๐ต๐ฎ๐ ๐ฐ๐ฎ๐ป ๐ฝ๐ผ๐น๐ถ๐ฐ๐๐บ๐ฎ๐ธ๐ฒ๐ฟ๐ ๐ฑ๐ผ? Expanding access to mediation isnโt just about passing laws. It requires: โ๏ธ Building institutions and trained mediators โ๏ธ Reducing structural bottlenecks in dispute resolution systems โ๏ธ Promoting a culture of negotiation over confrontation Because better dispute resolution isnโt just a legal issue, itโs an economic one.
