But as a recent landmark ruling from the UK Supreme Court proves, when the allegations escalate from administrative negligence to systemic fraud, the courts are more than willing to grant foreign tax authorities a second bite at the apple. The case of Skatteforvaltningen (SKAT) v MCML Ltd (formerly EDFM) is a study of intermediary liability, the limits of legal shields, and the relentless pursuit of sovereign funds. For financial brokers, supply chain intermediaries, and corporate litigators, the judgment delivers a stark warning: a procedural victory is not a permanent shield. The Backdrop: Tax Vouchers and the "Revenue Rule" The dispute stems from a highly lucrative, cross-border dividend withholding tax (WHT) scheme. Under international double-taxation treaties, certain foreign entities, such as North American pension funds, could claim refunds on taxes levied on Danish dividends. SKAT, the Danish Tax Authority, paid out these massive refunds based on "tax vouchers" submitted by EDFM, a London financial brokerage acting on behalf of its clients. When the scheme unraveled, SKAT pursued EDFM in the English courts. The 2018 Claim SKAT initially sued EDFM alleging negligent misrepresentation regarding 420 of these vouchers.
