Who Chooses India’s Election Referees? ⚖️ A Constitutional Showdown Ahead The battle over who appoints the guardians of democracy is back in focus. The Supreme Court of India will soon hear a crucial challenge to the 2023 law governing appointments of the Chief Election Commissioner (CEC) and Election Commissioners. 🔍 What’s the issue? The 2023 law changed the selection panel: Before (as per court guidelines): ➡️ PM + Leader of Opposition + Chief Justice of India Now (under the new law): ➡️ PM + Leader of Opposition + Cabinet Minister 👉 The Chief Justice of India is out. ⚖️ Why is this controversial? Petitioners, including Association for Democratic Reforms, argue: 🟠 This tilts the balance in favour of the executive ⚪ Weakens independence of the Election Commision 🟢 Undermines free & fair elections And here’s the key 👇 👉 Free & fair elections are part of the basic structure of the Constitution. 🧠 The legal backdrop In Anoop Baranwal v. Union of India, the Court had stepped in due to absence of a law and created a balanced selection mechanism including the CJI. But it also said: 👉 This will apply only until Parliament makes a law Now Parliament has acted—but the question is: 👉 Can that law dilute institutional neutrality? ⚠️ What’s really at stake? This isn’t just about a committee.
