In Communication Components Antenna Inc. v. Rosenberger Hochfrequenztechnik GmbH & Co. KG & Ors., the Hon’ble Delhi High Court delivered a significant patent infringement ruling, upholding the validity of Indian Patent No. 240893 relating to asymmetrical beam antenna technology and finding infringement by the Defendants' antenna products. The Court rejected the Defendants’ revocation challenge, held that the patented invention satisfied the requirements of novelty and inventive step, and granted a permanent injunction restraining the sale and promotion of infringing products. The Court further awarded damages of approximately ₹152 crores, along with additional royalty-based damages on undisclosed sales and full actual costs. This judgment reinforces the strength of patent protection in India and highlights the willingness of courts to grant substantial monetary relief where infringement is established and patentees’ rights are violated.
