Today, the Federal Court delivered a landmark ruling on the "πππππ π‘ππ π‘ π‘π πππ‘ππππππ π€βππ‘βππ π π βπππβπππππβπ πππππππππ‘ ππ πππ‘πππππππ ππ¦ π€ππ¦ ππ ππ ππππππ π ππ£π πππ‘πππ ππ π πππππ£ππ‘ππ£π πππ‘πππ". Tengku Maimun CJ, Abang Iskandar PCA, and Nallini Pathmanathan FCJ formed the eminent bench presiding over the appeal of ππ€π¬ πΎπππ£π ππππ π« ππ€π¬ πππ£ πππ. Dato' Lim Chee Wee and I acted as counsel for the successful appellants (π€βππβ ππππππππ‘ππππ¦, πππππ ππ’π π‘βπππ ππππ πππ’π‘ππ£π π€ππ ππ‘ π‘βπ πΉππππππ πΆππ’ππ‘ ππ π π‘πππ). We were instructed by Vasdev Bakshani and Arjan Pursumal as solicitors. In the brief grounds of judgment, Nallini Pathmanathan FCJ embarked on a historical analysis into the origins of derivative action, especially on the proper plaintiff rule (as enshrined in πΉππ π π£ π»πππππ‘π‘ππ) and no reflective loss principle (as restated in πππ£ππππππ π£ πππππ₯). Very much excited to behold the full grounds of judgment in due course β which promises to etch a high judicial watermark on corporate law.
