Thrilled to share a significant legal victory in the matter concerning Mr. K. V. Brahmaji Rao, former Executive Director of Punjab National Bank. Mr. Rao was unjustly named as an accused by the CBI in connection with the high-profile Nirav Modi–Mehul Choksi scam. Despite the absence of any evidence indicating misconduct, he was charged solely on vague allegations of failing to implement certain RBI circulars — a charge entirely disconnected from the core fraudulent activities under investigation. The prosecution's case reflected deep systemic flaws — both in its substance and process. The inclusion of Mr. Rao’s name appeared to be the result of superficial inquiry and flawed reasoning. Notably, the sanction for prosecution was granted under pressure from the Central Vigilance Commission, raising serious questions about institutional independence and fairness. We contested this at every stage: First, before the Delhi High Court, challenging the very sanction for prosecution. Then, before the Special CBI Court, seeking Mr. Rao’s discharge. The outcome has reaffirmed our belief in the rule of law. The judgment clearly recognizes that the CBI’s case was untenable — a vindication not only of Mr. Rao’s integrity, but also of the legal principles we stood by throughout. On a personal note, this case has been both demanding and deeply instructive. It gave me the opportunity to collaborate with several esteemed senior counsels, refining our arguments and expanding our legal approach. It also tested my perseverance through procedural delays, shifting rosters, and repeated adjournments. This win is more than a legal milestone — it’s a reminder of why we fight: to ensure that justice is not just done, but seen to be done.
