Government announcements last night regarding BNG consultations include several key updates in terms of minor developments: - Developments of 0.2ha or less, without onsite priority habitat, will be exempt from mandatory BNG. - The exemption for self/custom builds will be removed, relying instead on the above exemption. - A new exemption for temporary planning permission, limited to five years or less, has been introduced. - The 'de minimis' exemption remains in place but may be amended in the future. - Minor developments unable to apply an exemption will benefit from increased flexibility in how the 'mitigation hierarchy' is applied, facilitating easier use of offsite units. Defra will bring forward secondary legislation before summer recess 2026 with the intention of changes coming into force before 31 July 2026. These changes could help unlock some small sites where the BNG obligations have been difficult to achieve, our team are keeping up to date with these changes and can help advise on the best course for your project. https://lnkd.in/e2hYNAJN
