𝐍𝐨𝐭 𝐚 𝐰𝐚𝐬𝐭𝐞 𝐨𝐟 𝐚 𝐝𝐞𝐜𝐒𝐬𝐒𝐨𝐧. Our Planning and Environment team recently acted for Noosa Shire Council in Planning & Environment Court proceedings, where a decision was handed down clarifying when development approval conditions will be treated as β€˜reasonably required’ and not an β€˜unreasonable imposition’. The Court upheld Council’s requirement for onsite waste collection via bulk bins but rejected more restrictive servicing-hour limits, highlighting the importance of local context, existing activity levels and contemporary waste management practices.
