H&M tried to suppress our client's entire Federal Court case before it even got to a hearing. Not just certain documents. Everything. Their argument was that publicity might make settlement harder. The judge disagreed, finding there was no reasonable basis for the application at all, and ordered H&M to pay the legal costs. "Suppression orders have their place in certain circumstances, but 'this might attract bad press' isn't one of those situations. When companies try to use suppression to avoid scrutiny rather than protect a legitimate interest, those tactics should be called out," says Principal Lawyer Mia Pantechis.
