Lee & Lee is pleased to have acted in Glenford Tan Ming Loon & Anor v The Management Corporation Strata Title Plan No. 2823 [2026] SGMC 88 which is believed to be Singapore's first reported decision on an MCST's duty under section 29(1)(b) of the Building (Strata Management) Act 2004 to keep common property ground soil free of subterranean termites. District Judge Chiah Kok Khun found that the defendant MCST, having prior knowledge of termite infestation in the development, breached its duty by relying solely on reactive "search and destroy" pest control rather than proactive in-ground treatment and scanner-assisted inspection. The Court allowed the claimants' claim of S$10,978.00 in full and awarded costs of S$35,000.00 plus disbursements of S$7,749.93. The claimants were successfully represented by our Partner Daniel Chen and Associate Drashy Trivedi of Lee & Lee LLP.
