I’m sorry to say that the reasoning deployed by MacDonald J in his #judgment in Potanina v Potanin (No. 3)(Video Evidence from Abroad) [2026] EWHC 1738 (Fam) (https://lnkd.in/d2HRiiAs) regarding #witness #evidence by #videolink from #russia / #russianfederation is nothing short of #trustmebro #judicial #hocuspocus that is liable to be overturned on #appeal in the #courtofappeal. I’m sure that the likes of Gordon Exall, Matthew Lee, Rebecca Carew Pole KC, Anthony Metzer KC, Mansoor Fazli, Sarah Crowther KC, Jack Holborn, Professor Jo Delahunty KC MICarb, Peter Mant KC, Marcia Shekerdemian KC and Theo Barclay - and naturally the folks at Payne Hicks Beach LLP - would agree that the proposition by MacDonald J that #family #proceedings are somehow exempt from the procedural requirements attached to taking of #videolink #witnessevidence in all other #courts - be they #immigration #courts or just mainstream #civilcourts - is just pure fiction that treats established #jurisprudence in this field with open disdain. #civillitigation #witnessevidence #familylaw #law #evidencefromabroad #witness #videolink #familycourt #highcourt #litigation #lawyer #lawyers #videoevidence
