One German word in your Amazon title can get you a legal bill. Most US sellers have never heard of it. In Germany, advertising with "Testsieger" (test winner) — or "Nr. 1", or "the best" — without a cited, visible source next to the claim is treated as misleading under competition law (UWG). The penalty isn't from Amazon. It's an Abmahnung: a formal cease-and-desist from a competitor's lawyer, with costs attached. It's an entire cottage industry over there, and listings translated from US copy are the easiest targets. German courts (BGH) have been clear: the source has to be legible and right next to the claim — not buried in the fine print.
