Many said Diarra is not a Bosman. Think again! The FIFA transfer rules post-Bosman took 6 years. Post Diarra: 16 months. Unthinkable developments in October 2024 are now reality: - For this RSTP revision all partners were on the table – players, clubs and governing bodies, turning the RSTP into the first generic global CBA in professional sport. – Establishment of a Global Social Dialogue Platform for professional football, which will bring together employers (clubs and leagues) and employees (players), with the participation of the confederations. For the future, any change to the RSTP will be implemented only if there is full consensus between all these social partners. In other words, FIFA authoritarian governance is over. - For the first time ever, on player-related matters, FIFPRO will be represented on the FIFA Council as an observer with speaking rights. - Decisions affecting players’ workload and playing conditions in FIFA competitions (World Cup and Club World Cup) will be based on a structured, collaborative process between FIFA and FIFPRO, and both parties have committed to working together to promote a healthy balance between competitions at global, continental and domestic levels. - Player Participation in Transfer Fees: The revised RSTP introduces a revolutionary new concept, whereby players may participate in transfer fees paid in respect of them, in the context of an international transfer. - The famous Art. 17 is now fully restructured and modernised. Parties may predetermine the compensation due for a breach of contract, with clear limits and guardrails. - Minimum compensation: As a principle, a player and a club shall always be awarded, as a minimum, an amount equal to the residual value of the contract that was breached. - In addition to compensation, in case of abusive conduct, a penalty payment of up to six monthly salaries shall be awarded to a player or a club.
