A brief essay analyzing the development of the standard of proof regarding fraud (and other criminal elements) in civil cases in Malaysia. Despite the Federal Court's pronouncement in Sinnaiyah, there is still some ambiguity in certain areas of the law regarding the applicable standard, especially among the decisions of the Industrial Courts. *This essay was done as a project and submitted to Associate Prof Dr Jal Zabdi when the author was enrolled in the course LIA4007 Law of Evidence I in the Faculty of Law, University of Malaya.
