AI has made it easier than ever for 𝗺𝗮𝗹𝗶𝗰𝗶𝗼𝘂𝘀 𝗼𝗿 𝗾𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝗮𝗯𝗹𝗲 𝗮𝗰𝘁𝗼𝗿𝘀 to produce emails that look credible. Like many others, E. Blum & Co. AG is seeing a 𝘀𝘂𝗿𝗴𝗲 𝗶𝗻 𝘂𝗻𝘀𝗼𝗹𝗶𝗰𝗶𝘁𝗲𝗱 𝗮𝗽𝗽𝗿𝗼𝗮𝗰𝗵𝗲𝘀 — directed not only at us, but increasingly at patent owners. A growing number of fraudulent messages now claim to ‘invest in’, ‘acquire’ or ‘monetize’ your IP. Some malicious actors even use Swiss‑looking names to imply legitimacy despite having no Swiss presence at all. Several official bodies, including the World Intellectual Property Organization – WIPO, have repeatedly warned about such misleading invitations. If someone contacts you out of the blue offering to ‘unlock value‘ from your patents, 𝗮𝘀𝘀𝘂𝗺𝗲 𝗿𝗶𝘀𝗸 𝗳𝗶𝗿𝘀𝘁, 𝗻𝗼𝘁 𝗼𝗽𝗽𝗼𝗿𝘁𝘂𝗻𝗶𝘁𝘆. Red flags to watch for: • 𝗡𝗼 𝘃𝗲𝗿𝗶𝗳𝗶𝗮𝗯𝗹𝗲 𝗶𝗱𝗲𝗻𝘁𝗶𝘁𝘆. No entry in the commercial register, no professional footprint. • 𝗛𝗼𝗹𝗹𝗼𝘄 𝗱𝗶𝗴𝗶𝘁𝗮𝗹 𝗽𝗿𝗲𝘀𝗲𝗻𝗰𝗲. New domain, no team, no address, no track record. • 𝗚𝗲𝗻𝗲𝗿𝗶𝗰 𝗳𝗶𝗻𝗮𝗻𝗰𝗶𝗮𝗹 𝗷𝗮𝗿𝗴𝗼𝗻. Non‑dilutive capital”, “monetizing non‑core assets”, “unlocking value” — but no valuation method, no fund details, no due‑diligence process. • 𝗡𝗼 𝘁𝗮𝗿𝗴𝗲𝘁𝗲𝗱 𝗮𝗻𝗮𝗹𝘆𝘀𝗶𝘀. Vague references to “your technology” without citing a single patent or or family. • 𝗜𝗻𝗰𝗼𝗻𝘀𝗶𝘀𝘁𝗲𝗻𝗰𝗶𝗲𝘀. For example, Swiss branding paired with a foreign mobile number or email. • 𝗣𝗿𝗲𝘀𝘀𝘂𝗿𝗲 𝘁𝗼 𝗿𝗲𝘀𝗽𝗼𝗻𝗱 𝗾𝘂𝗶𝗰𝗸𝗹𝘆. Urgency is a tool, not a coincidence. A legitimate counterparty welcomes scrutiny. A questionable one evaporates under it. Before engaging with any unsolicited offer about your IP, speak with trusted counsel.
