Bill Jamieson and Goutami Sharma address the Appellate Division’s recent decision in Lee Yih Kang v Hsu Shih Hsun [2026] SGHC(A) 9, cautioning against overstating its impact on the electronic execution of deeds. While the court implicitly accepted electronic execution, the ruling is narrowly confined to witness attestation and leaves the common law requirement for a seal unaddressed. This decision does not provide the comprehensive statutory foundation required to resolve the status of electronic deeds. Given that the Electronic Transactions Act continues to exclude "indentures," the transition to paperless deeds remains a landscape of legal uncertainty.
