A draft EU Regulation on public contracts and concessions has been leaked. If taken forward in its current form, it would repeal all three existing EU procurement directives – the classical procurement directive, the utilities directive and the concessions directive – and replace them with a single, directly applicable Regulation. While the draft is currently only an internal Commission working document and may still change significantly, it offers an important insight into the Commission’s thinking: the EU is preparing the most ambitious overhaul of European procurement law since 2014.
