Recently the Supreme Court of India has observed (in Manhoor Fatima Imran Vs. Visveswara Infrastructure Private Limited), that registration of a Sale Deed will not confer title on the purchaser if the original agreement under which the property was initially purchased by the vendor was not registered. In this case the vendor had in its favour an unregistered agreement for sale coupled with disputed possession. Though the Supreme Court did not get into the question of determining the title of the parties to the property, the observations made under this decision are important as it effectively holds that a purchaser having a registered document for purchase of property is not enough if the title of the original vendor from whom he has purchased the property is not clear by reason of such vendor not having registered title deeds in its favour.
