הישג משפטי תקדימי במוסדות השיפוט של פיפ"א (FFT) ⚖️⚽ (English below) גאה לשתף בהחלטה מצוינת שהתקבלה לאחרונה בתיק בו ייצגנו את מועדון הכדורגל בנות נתניה במוסדות השיפוט הבינלאומיים של פיפ"א. התביעה הוגשה על ידי שחקנית ששיחקה במועדון. לכאורה – סכסוך קלאסי בעל "מימד בינלאומי" (International Dimension) שמקנה לפיפ"א סמכות לדון בתיק. אלא שבכתב ההגנה, העלינו טענת סף (Preliminary Objection) מהותית לחוסר סמכות: הוכחנו שלשחקנית יש במקביל גם אזרחות ישראלית, והיא נרשמה בפועל בהתאחדות לכדורגל כישראלית – ולכן מדובר בסכסוך פנימי לחלוטין. הצלחנו להראות לפיפ"א שהמבחן הקובע לסמכות אינו נשען רק על הדרכון הזר שמחזיק השחקן, אלא על הרישום הספורטיבי והזיקה שלו בפועל (בניגוד לתקדימי עבר בנוגע לשחקנים כפולי-אזרחות). התוצאה: התביעה נדחתה על הסף! היה תענוג לנהל את התיק הזה יחד עם שותפיי ממשרד נבו קידר בלום (NKB), Uri Kahana ועו"ד תמר לוינשטיין 💪 Precedent-Setting Legal Achievement at the FIFA Football Tribunal (FFT) ⚖️⚽ Proud to share an excellent decision recently rendered in a case where we represented Bnot Netanya FC before the international judicial bodies of FIFA. The claim was filed by a player who played for the club. On the surface, it appeared to be a classic dispute with an "International Dimension," which would grant FIFA jurisdiction to hear the case. However, in our Statement of Defense, we raised a fundamental preliminary objection regarding the lack of jurisdiction: We proved that the player concurrently holds Israeli citizenship and was actively registered with the IFA - The Israel Football Association as an Israeli player - making this an exclusively domestic dispute. We successfully demonstrated to FFT that the determining test for jurisdiction does not rely solely on the foreign passport held by the player, but rather on their actual sporting registration and active nexus (distinguishing from past precedents regarding dual-national players).
