WHEN "NO RATES ARE AVAILABLE" MAY NOT BE THE END OF THE SEARCH We are seeing an emerging trend in the instructions received by All-Rates. A growing number of instructions received involve taxi and private-hire claims where another reporting provider has been unable to obtain suitable comparative rate evidence. Undoubtedly these are more challenging instructions. The relevant market is narrower, and it is not enough simply to identify a comparable vehicle. However, difficult-to-obtain evidence is not necessarily unavailable evidence. A recent anonymised instruction illustrates the potential significance. The claim involved: 202 days of hire and a total hire claim exceeding £147,000. A report from an alternative provider was disclosed referencing a comparable vehicle, however the provider had confirmed that they could not source rates for a taxi and provided the report solely for social, domestic and pleasure purposes. Utilising our extensive experience in this area, our author was able to identify three providers advertising suitable comparable vehicles for licensed private-hire use. When those rates were applied across the claimed hire period, the comparative totals were approximately: £9,300 £9,800 £10,200 That represents a potential difference of around £137,000 between the claim presented and the basic hire rate evidence obtained. The report does not, of course, determine the outcome of the claim. Issues such as need, period, impecuniosity and the recoverability of individual charges must still be considered. The value of a reporting provider is not simply its ability to produce evidence in straightforward cases. It is also its ability to find appropriate evidence when the vehicle, permitted use or circumstances make the instruction considerably more difficult - area's in which All-Rates Ltd excel.
