The Hon’ble Bombay High Court has quashed and set aside an externment order passed under Section 55 of the Bombay Police Act, 1951 which restricted the petitioners to enter the limits of Nagpur City and Nagpur Rural Area. The primary contentions put forth by me were with respect to non-consideration of ingredients of Section 55 of the Act and no live-link between the offences since they were stale in nature. I heavily relied on 2013 SCC Online Bom 1432, Vijay Jadhav v. State of Maharashtra.
