In a Summary Civil Suit filed on the basis of dishonoured cheque, the trial court has rejected defendant’s unconditional leave to defend and directed him to deposit 50% of the outstanding amount. I laid emphasis on two judgments of the Bombay High Court (Para 7 in the order) which discusses law on granting leave to defend in cases of dishonoured cheques.
