We are pleased to share that the Honourable High Court of Sindh has allowed our High Court Appeal, setting aside an ex-parte ad-interim injunction restraining our clients’ development project. The impugned order had been obtained without full and frank disclosure, including concealment of prior proceedings where similar relief had been declined. The Court reaffirmed that suppression of material facts disentitles a party from equitable relief and vitiates interim orders obtained on that basis. Noting that the project was at an advanced stage with requisite approvals in place, the Court held that continuation of the restraint would unjustly prejudice developers and bona fide third-party allottees. The order dated 30.05.2022 was set aside, and the trial court directed to proceed expeditiously and decide the matter on its merits.
