Responsibilities
- Oversee the end-to-end lifecycle of all enforcement and litigation files, ensuring alignment with company financial goals and risk management policies.
- Serve as a strategic partner to the Operations, Risk, and Sales departments, providing expert legal counsel to optimize debt recovery strategies and mitigate commercial risk.
- Lead the execution of complex enforcement proceedings, including attachment, asset investigation, and sale processes, while streamlining collection workflows for maximum efficiency.
- Manage and mentor internal legal staff, supervise the performance of external legal counsel, and oversee third-party collection/field teams to ensure professional and results-oriented execution.
- Direct the preparation and negotiation of complex settlement agreements, restructuring protocols, and commercial legal documents.
- Oversee all commercial litigation processes, including objection annulment, declaratory actions, and debt claims, ensuring robust representation of company interests.
- Prepare and present comprehensive legal risk analyses and collection performance reports to the Head of Legal and the Board of Directors, fostering transparency in litigation outcomes.
- Develop and implement coordinated legal action plans that integrate legal requirements into the broader business strategy.
- Ensure rigorous compliance with Turkish legal regulations across all debt recovery and commercial sales activities.
Qualifications
- Bachelor’s degree from a reputable Law Faculty.
- Minimum of 8 years of extensive experience in litigation, enforcement, and debt recovery, with a proven track record in a managerial or senior legal position.
- Expert-level practical knowledge and application of Turkish Enforcement and Bankruptcy Law (İcra ve İflas Hukuku).
- Deep and comprehensive expertise in Turkish Commercial Law, with a specific focus on B2B sales regulations, contract law, debt recovery strategies, and corporate legal compliance.
- Demonstrated experience in high-volume collection portfolios within the banking, finance, or fintech sectors is highly preferred.
- Extensive experience in managing attachment (haciz), field collection processes, and leading complex restructuring/protocol negotiations.
- Advanced proficiency in the UYAP Avukat Portalı, with the ability to manage and optimize digital legal workflows.
- Strong strategic and analytical mindset, capable of preparing high-level legal risk analyses, performance reports, and executive summaries for senior management and the Board of Directors.
- Proven leadership skills in supervising internal legal teams, coordinating with external counsel, and managing third-party collection agencies/field staff.
- Proficiency in MS Office Suite and legal practice management software.
- Excellent written and verbal communication skills in both Turkish and English, with the ability to articulate complex legal matters to stakeholders.
