For a company and its existing stakeholders, the onset of financial distress presents a problem; for potential new stakeholders, it presents an opportunity. My skillset and experience are focused on helping companies resolve their financial difficulties, helping current stakeholders preserve value in their existing investments, and helping new stakeholders deliver on the investment opportunities they have identified, all within the context of an increasingly complex legal and financial environment. For me, success and job satisfaction come from assisting the client in achieving their commercial objectives and, ideally (although this cannot always be the case when insolvency looms), assisting all stakeholders in achieving a satisfactory outcome. My experience is centred on complex, multi-creditor, cross-border financial restructurings. Recent cases include: - advising the senior (RCF) lenders on the EUR360m restructuring and insolvency of the FinTyre Group owned by Bain Capital (2020) - acting for the co-ordinating committee of creditors on restructuring the US$1.4bn indebtedness of Ukrainian based steel maker Interpipe (2013-19) - acting for those senior lenders which are also swap counterparties on the insolvency proceedings and associated litigations relating to Marme Inversiones which owed c.EUR3bn from the sale and leaseback of Santander’s Spanish headquarters (2013-20) I have significant experience of: - out of court restructurings, the use of composition proceedings (like schemes of arrangement), stressed refinancings and emergency new money advances, insolvency proceedings and debt trading; - leading multi-disciplinary legal teams, devising complex implementation structures, stakeholder management and addressing and resolving intercreditor issues. I have acted at all levels of the capital structure (for sponsors, debtors, directors, bank lenders, fund investors, agents and trustees) and have good relationships with many financial institutions and restructuring advisory firms. When not at work, you can find me skiing or trekking in the mountains, scuba-diving, volunteering at the local food bank or pulling my hair out at the latest escapades of the England or Saracens rugby teams.
