My experience includes prosecuting and defending lender liability claims, breach of contract claims, disputes arising from the sale of real estate and businesses, misappropriation of trade secrets and a variety of other business torts. My representative matters include: obtaining a preliminary injunction enjoining the UCC sale of the assets of a world-renowned restaurant chain; obtaining the dismissal of a loan servicer's action against the guarantors of a mezzanine loan that financed the purchase of one of the tallest buildings in the country; obtaining summary judgment against a commercial tenant-in-common who failed to contribute its share of a discounted payoff amount due to a senior lender; defeating a major bank's motion for summary judgment seeking dismissal of the borrower's claim for breach of contract; successfully negotiating executive compensation and resignation agreements; and obtaining a preliminary injunction enjoining the UCC sale of the membership interests in the owner of a Class A luxury commercial building in Manhattan. I am admitted to practice in the Supreme Court of the United States, the United States District Courts for the Southern and Eastern Districts of New York, and the State of New York.
