Mr Pearce has over 30 years’ experience in dispute avoidance and dispute resolution including the negotiated settlement of over 120 major contracts. This has been made possible by over 50 years experience in engineering and some 30 years experience in tender preparation, pre-contract award negotiations, contract drafting, award, and administration, dispute resolution and contract finalisation. Most successful contracts: design, construct and operate for 4 years Yandi Mine ($102 million) and Yarrie Mine ($172 M) (1200 and 1800 page contracts). He has been an expert witness in an arbitration and also in three of the six litigations in which he has been involved. He successfully prepared a groundbreaking multimillion-dollar business interruption insurance claim. As a civil, project, cost and contracts engineer and then manager Mr Pearce has worked on in excess of 35 mine and civil construction projects in West Australia, the N.T., Indonesia, N.S.W., Queensland, South Australia, Tasmania and Zambia, and large civil engineering projects incl. expressways in England and Hong Kong and a concrete oil production platform in Scotland. Mr Pearce has a wide knowledge of accommodation facilities including camp operations, contract mining, drill and blast, earthworks, underground developments including shaft sinking and bored tunnels and the underground station for the new rail system under Perth. Mr Pearce’s knowledge has been gained in part through his purchase and overseas inspection of relevant equipment and the supervision of operation of that and other relevant equipment necessary for these activities. Major purchases include all the mining and all other mobile equipment for the Channar iron ore mine and the earth pressure balance tunnel-boring machine for the Perth railway tunnels. For this machine Mr Pearce attended the Factory Acceptance Testing in Kobe, Japan. Also conversant with insurances and maintenance requirements, costing systems, and quality assurance.

    August 30, 2020 Fell 3 metres from tree suffered undisplaced distal sacral (S5) body fracture, compound fracture T6, T7, T8 fracture T9, T10 with anterior disc space widening and concussion. Discharged from hospital on December 4, 2020 after 12 weeks in polyjacket. Took opportunity whilst in hospital to write up my overland trip, in a busload of 37 Australians, from Katmandu to London via India when it was possible to visit Srinigar in Kashmir and sleep in houseboats on Lake Dhal, Pakistan, Afghanistan (when the girls wore miniskirts), Iran (with the Shah in power), Turkey when we were welcomed as comrades from (Gallipoli), Greece, Yugoslavia, Austria, Germany, Brussels, Now on concentrated physiotherapy programme.

    Joint director of Erythrae P/L with Judy Pearce who consults on computer related matters, mainly systems analysis and Pick software. Through Erythrae P/L I provide services, mainly project engineering, contract, tender, negotiations, award, documentation, administration and finalisation and dispute resolution. Typical assignments have been Agnew Mining Company (Owner’s Representative - commissioning shaft complex), VEL Minenco (Contracts Engineer then Contracts Manager – construction Argyle Diamond Mine I wrote 3 and finalised 61 of the 81 contracts on the project and managed the production of the as commissioned documentation), Edward L. Bateman/Nedpac (Contracts Manager construction 3 gold mines, Bow River Diamond Mine and Hellyer base metal mine, resolution through Robinson Cox with the Administrator of Minax P/L of the dispute arising from the construction of the Maldon Gold Mine). From 1988 the companies I provided services to Minenco P/L for Channar Mining Services (Purchase all mining equipment, closeout S&M contracts, commissioning, manuals and as-builts – Construction Channar Iron Ore Mine, I finalised 41 of the 63 contracts on the project and, through Freehill Hollingdale and Page, provided evidence in the arbitration Abi Group v Minenco), Fluor Daniel for BHP Iron Ore tender, award and part administration of the contracts for the construction and operation of the Yandi Iron Ore Mine and the Yarrie & Nimingarra Mines, BHP Iron Ore, Henry & Walker P/L, Eltin Limited, Goldfields Gas Transmission Line (State Agreement phase), BHP Coal, Thiess Contractors through Hollingdales, Plutonic Gold/Homestake, Yilgarn Star through Blakiston and Crabb, Evans & Peck for Main Roads W. A., Merlin Diamond Mines and Thiess Contractors, Boral Contracting, Pasminco Century Zinc, Leighton Contractors W.A., KBR (RGP5, Hope Downs 1, Seven Mile Siding Upgrade,), Grange Resources and KBR (Hope Downs 4).
