Eliza Jane Saunders is a commercial and intellectual property barrister, registered patent attorney (molecular biology major) and trade mark attorney. Eliza has significant expertise resolving commercial disputes and running commercial litigation in the Federal Court, Supreme Court, County Court and Magistrate's Court. Expertise providing legal advice in relation to patents, trade marks, copyright, designs, plant breeder's rights, protection of confidential information, passing off, Australian Consumer Law and intellectual property related aspects of contracts. Expertise in advising Life Science companies and research institutes in relation to collaboration, commercialisation, AI and relevant regulations. Also HealthTech companies on regulatory aspects of software as a medical device, telehealth and other legal implications of bringing new technology in the health and wellness space to the global market. Considerable experience running IP litigation including patent and trade mark oppositions, appeal of office decisions, Supreme Court, Federal Court proceedings (including obtaining urgent interlocutory injunctions and summary judgement) and appeals to the Full Federal Court and High Court of Australia. Also experienced in the anti-counterfeit area for example customs border protection including legal proceedings to stop the release of goods by Australian customs, Anton Piller Orders and general brand protection. Awarded the ISPANZ prize and a prize from Microsoft for a dissertation on the patentability of embryonic stem cells. Co-author of the Australia chapter of The International Comparative Legal Guide to Patents. Other publications include "Hot-tubbing - Concurrent Evidence in Patent Cases in Australia" and "The disclosure of prior art information on the World Wide Web" in the Australian Intellectual Property Journal and various BRR Interviews.
